You agree that such electronic signatures will consist of clicking on buttons and/or checking boxes where indicated. You also consent to the use of electronic records, including records sent to you electronically, instead of receiving them on paper or by regular mail. Your consent will be effective upon accepting this terms and conditions on the foregoing web page. Your consent will apply to any transaction or agreement that you may enter into with us in the future that modifies or extends your original transaction. If you do not consent to the use of electronic signatures and Records, you will not be able to complete your application.

"Communication" means any disclosures, notices, and all other information related to the application including but not limited to information that we are required by law to provide to you in writing. "Online Service" means the submission of an application through Octane’s website and any other online product or service offered through our website in which you have enrolled that is not otherwise governed by an electronic disclosure and consent.

By accepting the terms of this E-Sign Act Disclosure, you are agreeing to the following:

1. We may electronically provide you all legal or regulatory Communications associated with this application for credit ("Application") and associated with any credit transaction that may result from this Application.

2. We may deliver Communications to you by any of the following methods: (a) by posting a notice and making the information available to you through the Online Service; or (b) by sending the information to an email address you have provided to us; or (c) to a wireless device you have designated; or (d) to the extent permissible by law, by access to a web site that we will generally designate in advance for such purpose; or (e) any other electronic means we have mutually agreed upon. Delivery of electronic Communications by any of these methods will be considered "in writing" and you intend that the electronic Communications have the same legal effect as written and signed paper communications. You agree to promptly notify us of any change in your contact information. You can update your contact information through the Online Service as well as by contacting Octane at (646) 809-4123

3. You may withdraw your consent to receive electronic Communications by contacting us at (646) 809-4123. If you withdraw your consent to receive electronic Communications, we may terminate your access to the Online Service.

4. You may obtain paper copies of the electronic Communications by printing them within the Online Service or by calling at (646) 809-4123. There is no fee for paper copies.

5. The minimum hardware and software requirements to access and retain the electronic Communications are:

   • A personal computer or other device meeting the following requirements:

     • Compatible Operating Systems

       • Windows 7 or higher
       • Mac OS
       • Android
       • iOS

     • Compatible Browsers (latest version)

       • Google Chrome
       • Safari
       • Edge

   • You will also need telecommunications connections to the Internet capable of receiving, accessing, displaying, and either printing or storing electronic Communications, and sufficient electronic storage capacity on your computer’s hard drive or other data storage unit.

   • You are solely responsible to keep your operating system and software up to date regardless of information as to system requirements as may be provided herein.

This Application for Credit ("Application") by you (and co-applicant, if applicable) ("you" and/or "your") is to Roadrunner Financial, Inc. ("Roadrunner", "we" and/or "us"). By moving forward with your application you understand and agree that you are granting Octane Lending, Inc. and its affiliates or subsidiaries, which includes Roadrunner, written permission to obtain a consumer report from one or more consumer reporting agencies to show you credit offers you prequalify for when financing with Octane Lending, Inc., its affiliates or subsidiaries and participating dealerships.

You acknowledge that the information provided herein is true, correct and accurate to the best of your knowledge. You authorize Octane Lending, Inc. and/or its affiliated companies, as required under the Fair Credit Reporting Act, to obtain your consumer report from one or more consumer reporting agencies and to check your credit, employment history, or any other information, and to report such information, and its credit experience with your, to others. You are at least 18 years of age. Alimony, child support or separate maintenance income need not be revealed if you do not wish to have it considered as a basis for repaying this obligation.

You understand that to check the rates and terms that you may qualify for, one or more soft credit pulls may be done by Octane Lending, Inc. and its affiliates or subsidiaries, that will not affect your credit score. However, if you choose to continue your application at a participating dealership, then your full credit report from one or more consumer reporting agencies will be requested, which is considered a hard credit pull and may affect your credit.

You understand that if you are provided pre-qualified credit offers and you contact a participating dealership in order to initiate a credit transaction in connection with such offer, you agree that Octane Lending, Inc. and its affiliates or subsidiaries may share the information in this application with the participating dealer in order to complete the transaction. That information may include personally identifiable information.

By providing your contact information such as phone number and/or email address, Octane Lending, Inc., its affiliates/subsidiaries, and/or its partnered dealerships, may call, send text messages (including calling and sending text messages using equipment to automatically dial telephone numbers) and/or send emails to you for any servicing, informational and marketing purposes related to your application and account. You understand and agree that we may always communicate with you in any manner permitted by law that does not require your prior consent.

You hereby certify that to the best of your knowledge and belief, the property intended to be purchased in connection with this application is for your personal use; You are aware that if the Application is approved and financing is provided, that your are fully responsible for making all payments for such property; that such property will be your possession or under your control until the amount financed and all finance charges have been paid in full; and that your are not permitted to purchase any property financed through Roadrunner for the benefit or use of another without the prior written approval of Roadrunner.

You understand and agree that Roadrunner, and/or its affiliated companies, may provide information about your transactions with Roadrunner to third parties (including consumer reporting agencies) for lawful purposes. ROADRUNNER MAY REPORT INFORMATION ABOUT YOUR ACCOUNT TO CREDIT BUREAUS. LATE PAYMENTS, MISSED PAYMENTS, OR OTHER DEFAULTS ON MY ACCOUNT MAY BE REFLECTED IN YOUR CREDIT REPORT.

Important Information About Account Opening Procedures: Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who requests to open an account prior to account opening. When you apply for credit, we ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents. Failure to provide the required information may result in denial of your request to open an account.

NOTICE TO NEW YORK AND RHODE ISLAND RESIDENTS: A consumer report may be ordered on you in connection with your application for credit. If you ask, we will tell you whether or not one was ordered and if one was, the name and address of the consumer reporting agency that provided it. Subsequent consumer reports may be requested or used in connection with an update, renewal or extension of the credit applied for without further notice to you.
